The claims administrator may deny a claim if he or she believes that your injury is not covered by workers’ compensation. This may include injuries that are not work-related or that occur while a worker is under the influence of alcohol. Missing information or documentation could also cause a claim to be denied. Once we identify the reason for the denial, we can begin working on an appeal.
- Notifying your employer and the insurance company of the appeal. We will notify your employer and their workers’ compensation insurance company that we are appealing the denied claim. At times, we may be able to fix processing or filing errors at this stage of the claim to have it reviewed and approved.
- Representing your interests at a workers’ comp hearing. We will prepare your claim for an administrative hearing, at which point a workers’ compensation judge will review the evidence to determine whether the appeal should be granted, and your claim approved.
