Life Insurance Denials
North & South Carolina Life Insurance Lawyers
Have you been denied life insurance benefits? Denied or delayed benefits can turn an already difficult situation into a traumatic experience. If you lost a loved one and are having trouble recovering life insurance benefits, Crumley Roberts is here for you. We care like family, listen to learn, and do what’s right.
Representing clients across North Carolina and South Carolina, our life insurance attorneys and support staff can investigate the situation to determine the cause for denial and best course of action to pursue the benefits to which you are entitled. In our experience, the majority of life insurance claims are denied for one of three reasons:
- The policyholder missed payments. An insurance company may deny a life insurance claim on the grounds that payments were missed, but this could have occurred due to processing mistakes on their part. Insurance providers also typically provide grace periods for late payments, which should be taken into account.
- The policyholder misrepresented facts when applying for coverage. Referred to as material representation, a policyholder that alters or conceals information in order to secure life insurance coverage may render a policy null and void. Beneficiaries may still be entitled to benefits, however, if the misrepresentations were unintentional or did not actually affect the policy.
- The death occurred during the policy’s contestability period. After a policy becomes active, life insurance companies have the right to investigate and deny claims for a certain period of time, called a contestability period. Even if a death occurs during this time, the claim should be fulfilled if there are no issues with the policy or circumstances surrounding the death.
